Congress Begins Week-Long Recess with a Heavy and Contentious Immigration and Refugee Legislative Agenda
Awaiting its Return

Congress has begun a week-long recess following the close of business today. 

Upon its return to Washington on Monday, May 7, the U.S. House of Representatives will remain in session through Friday, May 18, when it will begin an 11 day-long recess, returning to Washington again on Wednesday, May 30. 

Upon its return to Washington on Monday, May 7, the U.S. Senate will remain in session through Friday, May 25, at which time it will begin a week-long Memorial Day recess, returning to Washington again on Monday, June 4.

The schedule of immigration- and refugee-related legislative activity during the work period to come is beginning to fill out, with floor action scheduled or anticipated on such matters as the fiscal year 2013 appropriations bill that funds the Executive Office for Immigration Review (EOIR), and the State Criminal Alien Assistance Program (SCAAP), a budget reconciliation bill that effectively would bar undocumented aliens and other aliens without Social Security Numbers from making use of the refundable Child Tax Credit, and a House version of legislation reauthorizing funding for programs under the Violence Against Women Act that would roll-back protections in current law for battered aliens who are the victims of domestic violence.

Lots besides floor actions also are likely to occur once Congress returns from this brief, week-long recess. 
Action is likely in both the House and Senate Appropriations Committees during the coming work period on the Fiscal Year 2013 Homeland Security Appropriations bill, which is always chock full of immigration- and border security-related provisions and is the target of numerous immigration-related amendents each year.  The two appropriations panels also could move during the coming work period to produce the fiscal year 2013 appropriations bills that fund the federal government's refugee admissions, overseas refugee assistance, and refugee resettlement programs.

Is an Eleventh Consecutive Week of Discussions About Immigration Possible During the Coming Weekend's Sunday Public Affairs Programs?

Will the coming weekend's Sunday public affairs programs feature at least one discussion on the subject of immigration or the Latino for the eleventh week in a row?

Presidential politics, the Republican legislative agenda, the economy, and the ongoing War on Terror figure to be the big issues discussed on the airwaves during the coming weekend, with guests including the Speaker of the House, political strategists from both the Obama and Romney campaigns, and plenty of legislators, political pundits, journalists, and political operatives appearing on the programs.  Their presence pretty much ensures that there will be significant discussions about immigration and the Latino vote on at least some of the programs.

The big guest on the programs during the coming weekend will be Speaker of the House John Boehner.  Because of his position, he will be pressed on a number of issues.  But will he be asked to comment on Senator Marco Rubio's impending introduction of his DREAM Act alternative?  Appearances on the coming weekend's programs also will be made by Obama political operative Robert Gibbs and Romney Political advisor Ed Gillespie.  But the guest who almost ensures that there will be discussion on the programs about immigration and/or the Latino vote is Los Angeles Mayor Antonio Villaraigoso.

 
 
 

Republicans Boycott Proceeding as a Senate Judiciary Panel Holds Hearing on "the Constitutionality and Prudence of State and Local Governments Enforcing Immigration Law"

The Senate Judiciary Subcommittee on Immigration, Refugees, and Border Security held a hearing today "Examining the Constitutionality and Prudence of State and Local Governments Enforcing Immigration Law”.  No GOP senators showed up for the hearing.

The hearing featured impassioned testimony from
 former Arizona State Senator Russell Pearce, the author of SB 1070, the controversial immigration enforcement law that was the subject of the hearing.  The witnesses who testified in opposition to SB 1070 were equally passionate in expressing their opposition to the measure.  They included Arizona State Senator Steve Gallardo; former U.S. Senator Dennis DeConcini (D-AZ), Partner at DeConcini, McDonald, Yetwin & Lacy P.C., Tucson, Arizona; and Todd Landfried, Executive Director of Arizona Employers for Immigration Reform, Phoenix, Arizona.  

Only Subcommittee Chairman Charles Schumer and DREAM Act author Senator Richard Durbin made appearances at the hearing, with both senators making long and impassioned opening statements and firing most of their questions at former State Senator Pearce.  
Subcommittee Chairman Schumer used the hearing to announce that if the Supreme Court of the United States upholds the contested provisions of SB 1070, he will introduce legislation to prevent states from enforcing civil immigration law.

SB 1070 Highlight
the Coming Week's Extraordinarily Busy Immigration- and Refugee-Related Legislative Agenda

The day is finally upon us.

The Supreme Court of the United States is scheduled during the coming week to hear oral arguments in the case of Arizona v. the United States, a case challenging the constitutionality of four provisions contained in Arizona's controversial SB 1070 immigration enforcement law.  In addition to the oral arguments, themselves, action in Washington during the coming week relating to the Arizona law includes a Senate Judiciary subcommittee hearing and numerous briefings, press conferences, panel presentations, rallies, prayer vigils, and marches.  The Court will not likely rule on the Arizona v. United States case until June.  Regardless of how it rules, there will be long-lasting repercussions.

Lots is happening in Washington on other immigration and refugee matters during the coming week.  In all, there are four hearings, three markups, and one floor action scheduled for the coming week at which immigration- or refugee-related matters are either certain to be dealt with or that could be dealt with.

The coming week's scheduled hearings include an oversight hearing on the operations of the Department of Homeland Security at which Secretary of Homeland Security Janet Napolitano is scheduled to testify, the previously mentioned hearing on the constituitionality of SB 1070, and a hearing on the situation in Sudan.  Markups of significance during the coming week include a markup of the fiscal year 2013 bill that funds the Executive Office for Immigration Review and a markup of a bill measuring progress in Haiti since the January 2010 earthquake.  The big immigration-related floor action during the coming week is expected tol center around Senate floor consideration of legislation to reauthorize the Violence Against Women Act, a measure that contains numerous immigration-related provisions and that could be the target of a number of immigration-related amendments during floor consideration.

House and Senate Appropriations Panels Approve FY '13 Funding for the Executive Office for Immigration Review and the
State Criminal Alien Assistance Programs

Separate House and Senate panels have approved differing versions of the fiscal year 2013 appropriations bill that funds the Executive Office for Immigration Review (EOIR) and the State Criminal Alien Assistance Program (SCAAP), moving the two bills closer to being considered by the full Senate and the full House of Representatives.  

Action on the measures occurred on Thursday, April 19, 2012, with action in the Senate occurring in the full Committee on Appropriations and action in the House on that body's Appropriations Subcommittee on Commerce, Justice, Science, and Related Agencies.  

The Senate Committee on Appropriations approved its version of the measure by a vote of 28-1.  The House Appropriations Subcommittee on Commerce, Justice, Science, and Related Agencies approves its version of the bill by a voice vote.  No amendments to the measure were offered in either the Senate or the House.


The Possible Return of the Child Tax Credit Immigration Provisions and Hearings on Racial Profiling, the E-Verify Program, and the Deployment of the National Guard on the U.S. Border Highlight the Coming Week's Immigration- and Refugee-Related Legislative Agenda

Congress is set to return on Monday from a two week-long recess.  When it reconvenes, it will remain in session for two weeks before beginning yet another recess.  

Three hearings and the possibility of as many as six markups highlight what could be a crowded immigration-related legislative agenda during the coming week, including the possibility that a House committee could revive a proposal that would make it more difficult for some immigrant families to make use of the child tax credit. 

The coming week's scheduled hearings include one on racial profiling in the United States, another on the deployment of National Guard assets on the U.S. border, and a third on document fraud and the E-Verify system.  The immigration- or refugee-related markups that either are scheduled or that are anticipated in the coming week involve legislation implementing the House-approved Fiscal Year 2013 Budget Resolution and the possible mark up in both the Senate and the House of the fiscal year 2013 bill that funds the Executive Office for Immigration Review.

The House Committee on Ways and Means, House Committee on Agriculture, House Committee on Financial Services, and the House Committee on the Judiciary all could markup their budget reconciliation measures during the coming week.  Although it was uncertain at the time of this writing, it is possible that the House Committee on Ways and Means bill, in particular, could
include a provision, found in Section 5201 of the House-passed version of H.R. 3630, requiring that at least one parent have a Social Security Number to qualify for either the refundable (Child Tax Credit) or nonrefundable (Additional Child Tax Credit) version of the child tax credit, even if the children who are the subject of the credit are U.S. citizens.  The possibility that the House Judiciary Committee, House Financial Services Committee, or House Agriculture Committee bills will contain significant immigration-related provisions was seen as less likely, however, at the time of this writing.  It is always possible, of course, that Members could offer immigration-related amendments during those Committee markup sessions.  And both the House Appropriations Subcommittee on Commerce, Justice, Science an Related Agenies an its counterpart in the Senate are at least tentatively scheduled during the coming week to markup their fiscal year 2013 appropriations bills.  Provisions respecting the Executive Office for Immigration Review are certain to be in the measures.  But the measures also could become targets for amendments relating to litigation over Arizona's SB 1070 or the Alabama immigration enforement law.

Finally, as the week wears on, much of official and unofficial Washington will begin to turn their attention to the impending April 25, 2012, oral arguments in the Supreme Court of the United States in the case of Arizona v. United States, respecting the constitutionality of Arizona's SB 1070 immigration enforcement law.

Obama Makes New Promise for Moving Immigration Reform Legislation in His Second Term While Criticizing Arizona's Immigration Law and the Romney and GOP Position on the Issue

President Barack Obama made a new promise to Latinos on immigration reform legislation over the weekend, declaring, "I can promise that I will try to do it [move immigration reform legislation] in the first year of my second term."  The president cautioned, however, that he cannot do it without Republican support.  The President's comments came during an April 13, 2012, interview with Univision. 

President Obama was critical of Republicans' position on immigration, in general, and of former Governor Mitt Romney's (R-MI) position on immigration issues, in particular, during the interview.  "The challenge we've got on immigration reform is very simple," he said.  "I've got a majority of Democrats who are prepared to vote for it," he declared.  "I've got no Republicans who are prepared to vote for it," he continued.  The President said, however, that things are even worse than that, declaring that "we now have a Republican nominee who has said that the Arizona laws are a model for the country."  The President called the Arizona immigration law "very troublesome," saying that "these are laws that potentially would allow someone to be stopped and picked up and asked where their citizenship papers are based on an assumption."

President Obama declared, "what we need is a change either of Congress or we need Republicans to change their mind."  He said "I think this has to be an important debate throughout the country" and that "my passion for this issue is undiminished."

On the DREAM Act, the President said, "it is shameful that we cannot get that done."  He said he is "going to keep on pushing as hard as I can" and that he will "encourage the Latino community to continue to ask every Member of Congress where they stand on these issues."  He said "this is something I care deeply about.  It is personal to me."

Lugar Opponent Accuses Him of Voting to Give Social Security Benefits to Illegal Immigrants in GOP Candidates Debate

Despite running numerous campaign ads attacking Senator Richard Lugar (R-IN) on immigration, the Senator's GOP primary opponent, Indana State Treasurer Richard Mourdock, only mentioned the subject of immigration once during a televised April 11, 2012, debate between the two candidates. 

The exchange on immigration, which revolved around the question of whether Senator Lugar had twice voted to give Social Security benefits to illegal immigrants, lasted just 30 seconds.

NumbersUSA Launches E-Verify TV Ad Against House Ways and Means  Committee Chairman Dave Camp

In March of 2012, NumbersUSA, one of the leading immigration restrictionist organizations in the United States, promised to run ads in media markets around the country criticizing Members of Congress who they do not believe are sufficiently supportive of the enacment of legislation to make the E-Verify system mandatory for all employers. 

The organization now has three ads, including one that attacks House Ways and Means Committee Chairman Dave Camp and two attacking Speaker of the House John Boehner.

Congress Continues in Recess but Washington Faces a Contentious Immigration and Refugee Agenda Upon its Return Next Week

Congress continues in recess this week but wll return to Washington on Monday, April 16, 2012. Upon
 
its return, the House and Senate will remain in session through Friday, April 27, at which time they will begin a one week-long recess. Following that brief recess, Congress will return and remain in Washington until it leaves at the end of May for a week-long Memorial Day recess.

The schedule of immigration-related events for next week and beyond is beginning to fill out, with hearings scheduled or anticipated on such matters as the E-Verify program, racial profiling, the deployment of the Naitional Guard along the U.S. border with Mexico, and Arizona's S.B. 1070. 

Lots besides hearings is likely to occur once Congress returns from its Easter recess.  There will be numerous events in Washington leading up to the oral arguments in the case of
Arizona v. United States.  Senate floor action is possible during the coming work period on S. 1925, the "Violence Against Women Reauthorization Act of 2011", which contain a number of immigration provisions and could be the target of immigration-related floor amendments.  Aaction is possible in both the House and Senate during the coming work period on the Fiscal Year 2013 Homeland Security Appropriations bill, which is always chock full of immigration- and border security-related provisions and is the target of numerous immigration-related amendents each year.  And action is likely  over the next several weeks in several House committees and on the House floor on budget reconciliation legislation that could impact immigrants and refugee.
